DMCA Notice

This page explains how Sonark Marine responds to claims of copyright infringement under the United States Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512. If you believe content on our website infringes your copyright, please submit a complete DMCA notice using the instructions below. We will review and act on valid notices consistent with the DMCA.

How to Submit a DMCA Notice

Your written notification must include all of the following (see 17 U.S.C. §512(c)(3)):

  1. Your signature (physical or electronic).
  2. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are covered).
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (for example, the full, direct URL of the page where it appears).
  4. Your contact information (name, mailing address, telephone number, and email address).
  5. A good-faith statement that you believe the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement of accuracy and authority that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

What Happens After We Receive a Notice

  • We will review your submission for completeness and may contact you if clarification is needed.
  • If the notice is valid, we may remove or disable access to the allegedly infringing material.
  • We will notify the user who posted the material that it has been removed or disabled due to a DMCA complaint.

Counter-Notification (If Your Content Was Removed)

If your material was removed and you believe it was taken down as a result of mistake or misidentification, you may submit a counter-notification under 17 U.S.C. §512(g). Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (the exact URL if possible).
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or any district in which Sonark Marine may be found if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.

If we receive a valid counter-notification, we may restore the material unless the original complainant notifies us within ten (10) business days that they have filed an action seeking a court order to restrain you from engaging in infringing activity.

Repeat Infringer Policy

It is our policy in appropriate circumstances to disable or terminate access for users who are determined to be repeat infringers.

Knowingly False Claims

Under 17 U.S.C. §512(f), any person who knowingly misrepresents that material or activity is infringing (or was removed by mistake) may be liable for damages, including costs and attorneys’ fees.
